Introduction

The Cloud Software or SaaS (Software as a Service) Guided Energy (hereinafter "GUIDED") is provided by VOLTIFY, 72 RUE DE LA FOLIE-MERICOURT, 75011 PARIS (hereinafter "we" or "us") as the controller within the meaning of the applicable data protection law.

GUIDED enables you to store, evaluate, and analyze vehicle data. In the process of using GUIDED, we process personal data about you. Personal data refers to any information relating to an identified or identifiable natural person. We value the protection of your privacy when using GUIDED and aim to inform you about the personal data we process and how we handle it.

This privacy policy is accessible at any time under the "Privacy" menu item in GUIDED.

1. Information on data processing

Certain data is automatically processed as soon as you use GUIDED. Below is a detailed list of the personal data processed:

1.1 User account creation and login

When creating an admin user account for your company, we use your name and email address to set up a portal for your company on our software platform. This information is essential for establishing the user contract.

To provide our services, we require "vehicle access data" such as the vehicle manufacturer and credentials (depending on the manufacturer, this may include username/email and password or token) that you use in the mobile application or the vehicle manufacturer's website to connect the vehicle to GUIDED.

We use this mandatory information to:

  1. Verify your authorization to manage the vehicle

  2. Enforce GUIDED's terms of use and associated rights and obligations

  3. Contact you with technical or legal notices, updates, security messages, or other communications related to account management

We use the vehicle access data or VIN to connect the vehicle with GUIDED, collect vehicle data, and process it within GUIDED.

This data processing is justified because:

  1. It is necessary for fulfilling the user contract between you and us for the use of GUIDED, in accordance with Art. 6 para. 1 lit. b) GDPR, or

  2. We have a legitimate interest in ensuring GUIDED's functionality and error-free operation, which outweighs your rights and interests in protecting your personal data within the meaning of Art. 6 para. 1 lit. f) GDPR.

1.2 Vehicle data collection and use of GUIDED

Using the vehicle access data you provide or the VIN, our service connects to the interface offered by the respective vehicle manufacturer. Vehicle data is collected via this interface and processed on GUIDED for display and evaluation by your admin. This includes remotely retrieving data using the vehicle’s VIN, allowing real-time access to vehicle information.

GUIDED allows for various evaluations of vehicle data and other information. Vehicle data includes information made available through the interfaces, such as:

  • Vehicle information (e.g., model, license plate, VIN)

  • Vehicle data (e.g., location, speed, battery status)

  • Electric charging card data (e.g., charging sessions, usage history)

  • Usage data (e.g., mileage)

Location data is collected and used only when the vehicle is charging, specifically to fulfill the user contract by differentiating home charging from other charging sessions. We do not collect, use, or store location data when the vehicle is not charging.

This data processing is carried out solely to provide the service and is justified as necessary for fulfilling the user contract between you and us under Art. 6 para. 1 lit. b) GDPR for the use of GUIDED.

We may process non-personal information that is aggregated or de-identified to the extent that it cannot reasonably identify an individual. This information is used for corresponding functions and evaluations, particularly necessary for cross-user assessments.

2. Sharing and transmission of data

Your personal data will not be shared without your express prior consent, except in cases explicitly mentioned in this privacy policy.

As our business develops, our company structure may change due to legal form alterations, establishment, purchase, or sale of subsidiaries, company parts, or components. In such transactions, customer information may be transferred along with the relevant part of the business. Whenever personal data is transferred to third parties as described above, we ensure compliance with this privacy policy and applicable data protection laws.

Any disclosure of personal data is justified by our legitimate interest in adapting our corporate structure to economic and legal circumstances as necessary, provided that your rights and interests in protecting your personal data do not outweigh this interest, in accordance with Art. 6 para. 1 lit. f) GDPR.

3. Data storage period

We will delete or anonymize your personal data as soon as it is no longer required for the purposes for which it was collected or used, as outlined in the preceding paragraphs. Generally, we store your personal data for the duration of your usage or contractual relationship with GUIDED, plus an additional 6 months during which we retain backup copies after deletion, unless this data is needed for criminal prosecution or to secure, assert, or enforce legal claims.

Specific details in this privacy policy or legal requirements for storing and deleting personal data, particularly those we must retain for tax purposes, remain unaffected.

4. Your rights as a data subject

4.1 Right of access

You have the right to request information from us at any time regarding the personal data we process about you, within the scope of Art. 15 GDPR. You can submit such requests by post or email to contact@guided.energy.

4.2 Right to rectification

You have the right to request immediate rectification of any incorrect personal data concerning you. Please contact us at contact@guided.energy for this purpose.

4.3 Right to erasure

Under the conditions described in Art. 17 GDPR, you have the right to request erasure of your personal data. These conditions include situations where the data is no longer necessary for its original purposes, cases of unlawful processing, or when erasure is required by Union or Member State law. 4.4 Right to restriction of processing

You have the right to request restriction of processing in accordance with Art. 18 GDPR. This right applies particularly when the accuracy of personal data is disputed, for the period necessary to verify its accuracy, and when you request restricted processing instead of erasure where a right to erasure exists. It also applies when we no longer need the data for our purposes, but you require it to establish, exercise, or defend legal claims. 4.5 Right to data portability

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you based on Art. 6 para. 1 lit. e) or f) GDPR, in accordance with Art. 21 GDPR. We will cease processing your personal data unless we can demonstrate compelling legitimate grounds for processing that override your interests, rights, and freedoms, or if the processing serves to establish, exercise, or defend legal claims.

4.7. Right to file a complaint

You have the right to lodge complaints with the competent supervisory authority. The competent authority in this case is the Baden-Württemberg State Commissioner for Data Protection and Freedom of Information.
